Indianen hoeven tóch geen belasting te betalen op verkoop tabak

Idaho. De staat wilde indianen in reservaten gaan verplichten om belasting te betalen op de door hun verkochte tabaksartikelen, maar het Huis van Afgevaardigden steekt daar nu een stokje voor.

De uitspraak van het Huis is interessant omdat steeds meer Indianen via Internet sigaretten verkopen. Daar wordt gretig gebruik van gemaakt door rokers in diverse andere staten, waar de prijs van sigaretten door belastingverhogingen de pan uit rijst.

The bill would have collected the 28 cents per-pack tax from cigarette wholesalers before they were delivered tobacco products to tribal retailers. All five Indian tribes in Idaho opposed the bill, claiming the state had no right to impose any tax on sovereign tribal lands.

The argument rang true with a number of House conservatives, including Rep. Jim Clark of Hayden, who said the Idaho Constitution and Supreme Court law prohibited imposing state taxes on reservation sales.

In most instances, the United States views tribal governments on par with state governments, which are not allowed to tax each other.
